1. Introduction

By accessing or using the services (“Services”) provided by EXTRA SAFE (“we,” “us,” “our”), including our website and communication platform (collectively, the “Platform”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree with any part of these Terms, do not use or access our Platform.

2. Description of Services

2.1 Platform Overview

  • Communication App (EXTRA SAFE): A private, peer-to-peer (P2P) communication platform protected with asymmetric encryption, where encryption keys are generated and stored only on your device. In the browser version, each call uses a one-time Ethereum-like account, while the mobile app creates a permanent Ethereum-like account upon first launch. Data never passes through our servers in unencrypted form, and we do not store or have access to your messages or call data.

  • Website: Provides information about our product and uses cookies and analytics tools for performance monitoring, service improvement, and relevant marketing.

2.2 No Data Storage or Metadata Collection

  • Your messages, call logs, and participant identifiers never pass through our servers. Our servers act only as connection initiators, making your device capable of functioning like a server so calls and messages travel peer-to-peer, directly between users. We do not collect or store any user-generated data.

  • You are not required to create an account or provide personal information (e.g., phone number, email) to use the communication service.

  • Anonymous technical performance data may be collected through trusted third-party analytics providers (e.g., Google Analytics, Firebase, Appsflyer) to improve functionality. This data is never linked to your identity.

3. User Responsibilities

  • Lawful Use: You agree to use the Platform in compliance with all applicable laws and regulations.

  • No Illegal Content: You agree not to transmit or share illegal, harmful, or offensive content through the Platform.

  • Device Security: You are responsible for maintaining the security of your device(s). We are not responsible for any data leak resulting from insecure device practices or unsafe internet activity outside of our control.

4. Intellectual Property

  • Ownership: All content, branding, and design elements on our website are owned by EXTRA SAFE. These include logos, text, graphics, and software.

  • Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Platform freely in accordance with these Terms.

  • Restrictions: You may not reproduce, distribute, modify, or create derivative works from our content.

5. Cookies and Analytics

  • Cookie Usage: We use cookies to analyze website performance, improve our services, and enable relevant marketing. By using our website, you consent to our cookie practices.

  • Analytics: We rely on third-party analytics tools (e.g., Google Analytics, Firebase, Appsflyer) to gather aggregated, non-personally identifiable data about site usage, device type, crash logs, and general usage patterns. This information helps us improve service performance and is never linked to your identity.

  • Marketing: Cookies also help us gauge the effectiveness of our marketing campaigns and tailor content or promotions.

6. Disclaimers

While the EXTRA SAFE app uses P2P and asymmetric encryption to protect all communications, no technology can be guaranteed 100% secure against every possible threat or vulnerability.

7. Limitation of Liability

Indirect Damages: EXTRA SAFE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of the Platform.

8. Modifications to the Terms

We reserve the right to change or update these Terms at any time, without prior notice. Any changes become effective immediately upon posting the revised Terms. By continuing to use or access the Platform after changes are posted, you consent to those changes.

9. Termination

We may, at our sole discretion, suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct detrimental to the Platform or its users.

Section 11. EXTRA WALLET — Mobile App Only

The provisions in Sections 11, 12, and 13 apply exclusively to users of the EXTRA SAFE mobile application (iOS and Android operating systems). They do not apply to the web platform or the browser-based services of EXTRA SAFE.

11.1 EXTRA WALLET Overview

EXTRA WALLET is a non-custodial cryptocurrency wallet integrated within the EXTRA SAFE mobile application. It enables users to store, send, and receive supported digital assets. Private keys are generated and stored exclusively on the user's device. EXTRA SAFE does not have access to your private keys or funds, nor does it collect or store this data, in order to maintain your privacy as a fundamental principle of EXTRA SAFE.

11.2 User Responsibility

You are solely and exclusively responsible for all aspects of your use of the EXTRA SAFE application and EXTRA WALLET, including, but not limited to, safeguarding your seed phrase and private keys. By accessing or using the application in any manner whatsoever, you expressly acknowledge and irrevocably confirm — having fully and deliberately considered the matter — that your use of the application is entirely and exclusively at your own risk, and that you assume full, sole, and absolute responsibility for any loss, damage, cost, or consequence of any kind that may arise from such use, whether direct, indirect, foreseeable, or unforeseeable. Loss of your seed phrase means permanent and irreversible loss of access to your wallet. EXTRA SAFE cannot and does not restore access, and bears no liability of any kind for such loss or for any other loss or damage arising from your use of the application.

11.3 No Financial Advice

Nothing in EXTRA WALLET or in these Terms constitutes financial, investment, or legal advice. Cryptocurrency values are highly volatile, and you may lose the entire value of your assets. You use EXTRA WALLET strictly at your own risk. EXTRA SAFE expressly disclaims all responsibility or liability of any kind for any financial loss, loss of digital assets, or any other damage or harm of any kind, arising from your use of EXTRA WALLET, your cryptocurrency transactions, or any volatility in the cryptocurrency markets.

11.4 Regulatory Compliance

The use of EXTRA WALLET may be restricted or prohibited in certain jurisdictions. You are solely and exclusively responsible for ensuring that your use complies with all applicable laws and regulations in your country of residence and in any jurisdiction from which you access the application, including all regulations regarding cryptocurrency ownership, transactions, and taxation. EXTRA SAFE bears no responsibility or liability of any kind for your failure to comply with applicable laws or regulations, or for any penalty, consequence, or damage arising therefrom.

11.5 Assumption of Risk; Full Release of Liability; Indemnification

By downloading, installing, accessing, or using the EXTRA SAFE application in any manner whatsoever, you hereby expressly, knowingly, voluntarily, and irrevocably declare that you:

  • (a) Confirm that you have read, understood, and carefully and deliberately considered all risks associated with the use of the EXTRA SAFE application and EXTRA WALLET prior to using the application;

  • (b) Assume full, exclusive, and personal responsibility for any and all risks, losses, damages, expenses, costs, claims, or liabilities of any kind — whether direct, indirect, incidental, special, consequential, or punitive — that may arise from or in connection with your use of, or inability to use, the application, regardless of the cause or foreseeability thereof;

  • (c) Fully, finally, and irrevocably release, waive, and discharge EXTRA SAFE, its officers, directors, employees, agents, affiliates, licensors, and successors from any and all claims, demands, causes of action, and liabilities of any kind, whether known or unknown, foreseen or unforeseen, arising out of or in any way related to your use of the application;

  • (d) Acknowledge and agree that EXTRA SAFE shall have no liability whatsoever — to any extent and under any legal theory — for any loss, damage, injury, or harm of any kind, including but not limited to, financial loss, loss of digital assets, loss of data, loss of income, or any consequential, incidental, or special damages, arising from your use of or inability to use the application, even if EXTRA SAFE has been advised of the possibility of such damages; and

  • (e) Agree to indemnify and hold harmless EXTRA SAFE and its officers, directors, employees, agents, and affiliates, from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the application or your breach of these Terms.

Your continued use of the application constitutes your ongoing, knowing, and intentional acceptance and reaffirmation of the aforementioned assumption of risk and full release of liability. If you do not agree to these terms, you must immediately cease using the application.

11.6 Reliance on User Declarations as a Fundamental Condition for Use

The user declares and acknowledges that their declarations and obligations under these terms, including, without limitation, the assumption of risks and the full release of Extra Safe from liability, constitute a fundamental, material, and inseparable condition for granting permission to use the application. Extra Safe permits the user to access and use the application solely in reliance upon these terms, and in the absence of such consent and declarations by the user, Extra Safe would not have permitted the user to use the application and would have strictly prohibited and denied them any access to it or its services.

Section 12. Cryptocurrency Risk Disclosure — Mobile App Only

  • Cryptocurrency transactions are irreversible. Sending funds to an incorrect address cannot be undone.

  • The value of digital assets can fluctuate significantly, and you may lose some or all of your funds.

  • Regulatory changes in your jurisdiction may affect your ability to use EXTRA WALLET or related services.

  • EXTRA SAFE is not a licensed financial institution, a money transmitter, or a Virtual Asset Service Provider (VASP) in your jurisdiction.

The user expressly acknowledges and confirms that all risks described in this Section 12 were fully known and understood by the user prior to using the application. By using the application, the user expressly assumes all such risks and fully and irrevocably releases EXTRA SAFE from any and all liability arising therefrom. EXTRA SAFE shall bear absolutely no liability whatsoever for any loss or damage — of any kind or nature — resulting from any of the risks described in this Section 12 or elsewhere in these Terms.

Section 13. Governing Law and Exclusive Jurisdiction

The user expressly agrees and acknowledges that these Terms of Use, their interpretation, and any dispute, claim, or cause of action arising from or in any way related to the use of the application or the services of EXTRA SAFE, shall be governed exclusively by the laws of the Republic of Estonia. It is hereby agreed that the unique and exclusive jurisdiction to hear and determine any such legal proceeding, dispute, or controversy shall be vested solely in the competent courts of Estonia. The user irrevocably submits to the exclusive jurisdiction of these courts and hereby waives in advance any claim of an inconvenient forum (Forum Non Conveniens) or any other objection to their jurisdiction.

By using our Platform, you acknowledge that you have read, understood, and agree to these Terms of Use.
